Rye PBA News

    On Monday September 10th, the Rye Police Association in partnership with the Apawamis Club of Rye, hosted the annual Rye Police Association Scholarship Golf Outing. One Hundred and Twenty golfers teed off shotgun style at approximately 1200 p.m. to enjoy a day of good golf, good food and camaraderie at the storied Apawamis Golf Club. The proceeds from the event go to fund the Rye PBA Scholarships, given each year to Rye residents and dependants of Rye PBA active members.
    Numerous door prizes were awarded to participants. Longest drive, closest to the pin and hole in one prizes were also up for grabs, though no one was able to drain the hole in one to win the 2007 Jeep Wrangler put up by Biltmore Motors of Rye.
    Numerous Rye PBA members and other volunteers were on hand doing the grunt work that made it all possible. See our
volunteer 2007 page for a listing of all that worked so hard to make the outing a great day. We also have a gallery of golfers with pictures and a list of golfers that you can view.

 1.   In September of 2006 The Rye Police Department announced interviews for the position of detective, created by the retirement of Det Paul Kenny, several months earlier. Effective August 15, 2007, Officer Gary Olivier was promoted to fill the position. A 23 year veteran of the Rye Police Department, Det. Olivier is best known around Rye as the News of the Week commentator and Marine Unit Officer. The PBA membership wishes him well in his new role.

2.    Interviews to potentially fill vacant patrol positions are scheduled to begin the week of August 13th, 2007. Since the department inexplicably missed hiring anyone for this session of the police academy, we will wait and see what timetable there is for hiring these people. The PBA wishes all candidates the best of luck.

    The City of Rye and Lt. Robert Falk have lost another round in the lawsuit they filed against Police Officer Timothy Chittenden. Lt. Falk and the City of Rye sued Police Officer Chittenden, with unauthorized Rye taxpayer money, more than 3 years ago to have him fire his Attorney, Jonathan Lovett. Mr. Lovett is representing Officer Chittenden for the frivolous departmental charges filed against him which stemmed from Officer Chittenden arriving to work 2 ½ hours early more than 4 ½ years ago. Officer Chittenden demanded a public hearing 4 years ago to prove his innocence. Rather than give Officer Chittenden his public hearing so he could prove himself innocent, Lt. Falk and the City of Rye filed this frivolous lawsuit against him to, in our opinion, delay the public hearing to save themselves from the embarrassment and career damaging testimony they would be forced to give under oath. 

After initially losing the lawsuit on April 18, 2005, rather than give Officer Chittenden a public hearing at this time, Lt. Falk and the City of Rye appealed to the Second Judicial Department of the New York State Appellate Division. They did so with City of Rye taxpayer money. On December 12, 2006, the Appellate Division ruled unanimously against Lt. Falk and the City of Rye.

Rather than give Officer Chittenden a public hearing at this time, Lt. Falk and the City of Rye used more City of Rye taxpayer money to appeal the Appellate Division’s unanimous decision to the same Appellate Division. The chances of overturning a unanimous decision at this level are slim at best. Regardless, Lt. Falk and the City of Rye amazingly also asked the same Appellate Division, which had already unanimously rejected their appeal, if they could go to New York States highest Court, the New York State Court of Appeals. Once again they used Rye taxpayer’s money to appeal the unanimous decision against them which also further delayed Officer Chittenden’s public hearing. Not surprisingly, the Second Judicial Department of the New York State Appellate Division ruled unanimously against Lt. Falk and the City of Rye and also unanimously denied their motion to appeal to the New York State Court of Appeals.

Officer Chittenden still wants a public hearing to prove his innocence and to bring to light malfeasance, misfeasance, incompetence, discrimination, union animus and alleged criminal acts by the Rye Police Administration to the forefront. In addition, Officer Chittenden and the Rye Police Association want to know why the City of Rye Administration and the Rye City Council have ignored and have refused to address the malfeasance, misfeasance, incompetence, discrimination, union animus and alleged criminal acts by the Rye Police Administration. Now that Lt. Falk and the City of Rye have exhausted all of their appeals, and perhaps hundreds of thousands of Rye taxpayer dollars in the process, maybe Officer Chittenden will get his public hearing.

    The Rye Police Department recently held interviews for the position of sergeant, created by the retirement of Alvin Ortiz. Officer Susan Rigano was promoted to fill the position. Sgt. Rigano is assigned to the patrol division. The PBA membership wishes her well in her new role.

    The Rye PBA yearly solicitation drive has begun. Our association's letter may be viewed here. The PBA does not engage in any type of phone solicitation or door to door activity, this letter mailed to the residents is the only fund request we make.

    Interviews have finally been scheduled to replace retired Rye Detective, Paul Kenny. Det. Kenny retired in April 2006. The long overdue interviews are slated to begin at the end of January. A second detective, Det. William Capaccio, will be retiring shortly. The Rye PBA wishes all participating members the best of luck.

    Sgt. Alvin Ortiz, a 24 year veteran of the City of Rye Police Department, announced his intention to retire at this month's PBA meeting. Sergeant Ortiz has held numerous positions in the association's executive board & spent many years on contract negotiation committees.
    Sgt. Ortiz has held various positions in the department including patrolman, youth detective, detective and patrol sergeant.
    Sgt. Ortiz has enjoyed a wonderful relationship with the citizens of the City of Rye and has remarked many times how he came to think of Rye as a second home.
    Plans for a retirement party have yet to be finalized.

    The Rye Police Association welcomes its' newest member, Albert P. Hein. Albert was accepted into the association at the January 15th PBA Meeting, held at Durland Scout Center. Officer Hein is currently attending the Westchester County Police Academy for basic police training. The Rye PBA wishes him the best of luck in his career.

    The records department has finally been moved out of its' mold infested office into a construction trailer. Work continues on the rear of the building to complete the renovations made necessary by a serious mold infestation. The optimistic four month timetable set by the city for completion of the work appears to be stretching into its' six month.
